The legal strategy recommended by lawyer Fusillo consists primarily of joining the urgent collective appeal for the suspension of the vaccination mandate, which, if granted, suspends the vaccination mandate for all participants and, if one has been suspended from work or demoted, entails reinstatement to one's duties from the moment of suspension, along with the recovery of salary accrued during the suspension period. Alongside the collective appeal, there are actions aimed at putting "sand in the gears" of the procedure laid down by Decree-Law 44/2021. To this end, we advise against replying to the first notice (the one without a vaccination date) and instead recommend replying only to the certified email (PEC) or registered letter specifying the appointment date for vaccination.
For those who cannot afford to be suspended from their job but do not intend to be vaccinated, we advise delaying vaccination for as long as possible (through postponements, sick leave requests, annual leave, statutory leave, and various pretexts). It is worth remembering that an employee who is absent from the workplace for various reasons (leave, Law 104, annual leave, parental leave, etc.) is under no obligation to be vaccinated, because the mandate applies only to those who are actually carrying out professional healthcare-related activities. If submitting to the blackmail becomes strictly necessary, it is advisable to wait for the formal suspension order from work.
If, following suspension, it should become necessary for personal or financial reasons to be reinstated to one's previous duties and salary, this is always possible, at any time and irrespective of any steps taken, by undergoing vaccination.
