STAGES OF THE LEGAL CHALLENGE AND UPDATES:
20 September 2022 - At the hearing for the discussion of the collective legal challenge against the Workplace and School/University Green Pass, the judge could have decided the case but preferred to order, via a ruling published today, an adjournment to 3 May 2023 for oral argument, granting the parties a deadline until 4 April to file final written submissions.
Naturally, the timing and conduct of the proceedings are entirely in the hands of the court, and unfortunately lawyers cannot influence this in any way!
The impression is that the Court of Rome, like other courts in various proceedings, wishes to await the decision on the constitutional questions regarding compulsory vaccination that will be argued before the Constitutional Court on 29 November, proceedings in which Avv. Fusillo, on behalf of the Confederazione Legale per i Diritti dell'Uomo, has filed an "amicus curiae" brief.
8 September 2022 - Unfortunately, the hearing of 20 September will be conducted solely in written form because emergency regulations still severely restrict in-person hearings. You can download the text of the legal challenge here.
May 2022 - The court informs us that the hearing has officially been set for 20 September. For those who wish, it is still possible to join the legal challenge until 30 June. Watch the update video.
1 April 2022 - The new law decree does NOT alter the substance of the mandates and does not hinder the legal challenge in any way. We are still waiting for the court to schedule the first hearing...
1 February 2022 - The application, updated with everything established by the new December and January decrees, is lodged with the court; watch the video on the filing. We are now waiting for the court to schedule the first hearing...
November 2021 - The application is about to be lodged with the court, but Fusillo decides to postpone, suspecting that the government is about to issue new decrees that would risk invalidating the challenge.
IMPORTANT! Read this before registering!
- ELIGIBLE TO JOIN THE LEGAL CHALLENGE:
- Anyone who is of legal age and is or has been subjected to coercion in the workplace, whether through the basic Green Pass, the 'reinforced' Super Green Pass, or mandatory vaccination.
- You can join regardless of age, occupation, or whether you are an employee, self-employed, a shopkeeper, a sole trader, etc.
- Healthcare workers who did not join the first collective legal challenge for healthcare staff may participate.
- You may take part whether you are currently working, suspended, on leave, on holiday, etc.
- EDUCATION SECTOR: you will be asked for different documentation; please sign up → via this page.
- LAW ENFORCEMENT: ONLY Local Police (Polizia Locale) and Park Rangers (Guardiaparco) may participate.
- NOT ELIGIBLE TO JOIN THE LEGAL CHALLENGE:
- State Police and Carabinieri (FFOO), military personnel, magistrates, defence sector personnel, and firefighters, as they fall under a different jurisdiction.
- Healthcare workers who joined the first collective legal challenge: anyone who did not take part in that challenge CAN PARTICIPATE!
- The legal challenge is NOT brought against your employer, who has no way of knowing whether you have registered: the challenge is against the measures contained in Law Decree 52 as updated by all subsequent Law Decrees up to Law Decree 1 of 2022.
It is now clear that the government is pursuing the intention of destroying life as we knew it and demolishing the small businesses that formed the productive and social fabric of the country. They want to incite citizens to polarise into two opposing camps, vaccinated against unvaccinated, on the back of the lies spread by the government. It is time to fight back on all fronts!
You will note that the IBAN for paying the legal fees belongs to a Belgian bank (simply set up a SEPA transfer, fee-free across Europe). Unfortunately, we have encountered difficulties with Italian banks in handling incoming payments, and we fear there may be "interference" with the work we are carrying out. We appreciate your understanding. Taxes and invoicing will all remain in Italy; an electronic invoice will be issued and made available in your online tax account (cassetto fiscale).
The sum of €95 (inclusive of 22% VAT and 4% lawyers' pension contribution) covers all levels of jurisdiction (both Italian and European) that may prove necessary to prevail and, as soon as 1,000 participants are reached, a reserve fund will be established to cover any adverse costs orders up to €20,000!
