BACK TO SQUARE ONE – The judgment of the EU Court of Justice

Owing partly to a phrasing of the question that was not entirely clear and a highly formal approach on the part of the EU Court of Justice, the preliminary reference from the Court of Padua concludes with a purely procedural judgment of inadmissibility. However, there are useful insights in the decision, and the path of disapplication remains open to all Italian judges.
