BACK TO SQUARE ONE – The judgment of the EU Court of Justice

Owing to phrasing of the question that was not entirely clear and a highly formalistic approach by the EU Court of Justice, the preliminary reference from the Court of Padua concludes with a purely procedural judgment of inadmissibility. The ruling does, however, offer useful insights, and the avenue of disapplication remains open to all Italian judges.
