Following the written hearing of 25 January 2024, the Rome Court of Appeal adjourned the case for oral argument to the hearing of 20 June 2024, granting the parties a deadline of 10 days prior for filing written concluding submissions. It is good news that the timeframe is short, but the signals emerging from the ordinary judiciary are not encouraging.

La Nuova Bussola Quotidiana recently published a document from the Case Law and Documentation Office of the Court of Cassation entitled “Review of the Case Law of the Supreme Court”, wherein—although the Court of Cassation has never ruled on the emergency legislation, the Green Pass, or the Covid-19 vaccination mandates, and there was therefore no review of judgments to publish—the Supreme Court gets ahead of itself by explaining that everything is fine, that the violations of the Constitution were justified by the emergency, that the vaccination mandates and the requirement to hold a Green Pass were lawful and did not conflict with Article 3 of the Charter of Nice, which is purportedly an inapplicable provision in healthcare matters, that discrimination against the unvaccinated was lawful, and that the only competent authorities to consult on the matter are the ISS and AIFA. Unfortunately, the judiciary—with a few commendable exceptions—shows no sign of wishing to begin defending the rights of citizens rather than the interests of the political establishment responsible for the destruction of fundamental rights we have witnessed since March 2020. This must not discourage us in our battle. Reason and truth are on our side.
