An amendment to the conversion bill of the so-called 'milleproroghe' decree (215/2023) is expected to extend the suspension of fines for unvaccinated over-50s until 31.12.2024. The final vote is expected on 15 February.
If the amendment passes, as is almost certain, the fines, enforcement, payment and any appeals would remain suspended until the end of the year. Therefore, the advice to do nothing for now would remain valid. Naturally, it is necessary to await the approval and publication in the Official Gazette of the conversion law. Those who argued that it was necessary to appeal the fines immediately because otherwise there would be a risk of distraint by the Revenue Agency were mistaken. Until the deadline for payment expires (sixty days after the end of the suspension period), collection is not possible and no deadline for an appeal expires.
The excuse put forward by the government for failing to repeal the fines—namely the difficulty of finding financial coverage, given that the expected revenue had reportedly already been included in the state budget—is not serious and demonstrates a lack of respect for citizens' fundamental rights. It is worth recalling that under Article 3 of the Charter of Nice, mandatory medical treatment is unlawful and domestic provisions providing for it must be disapplied.
