CHALLENGE TO FACE MASK ORDER – LAZIO REGIONAL ADMINISTRATIVE COURT ADJOURNS TO 30 APRIL
In the pilot appeal brought against the Ministry of Health orders that continue to mandate masks in healthcare facilities until 30 June 2024, the Lazio Regional Administrative Court did not deem it appropriate to take a position on the request for an immediate decision on the merits pursuant to Article 60 of the Code of Administrative Procedure, confirming the adjournment of the case to 30 April, when only two months will remain before the ministerial order expires. In the meantime, healthcare workers and facility users will continue to be unlawfully forced to use useless masks which, while unable to prevent the spread of any virus, result in the inhalation of toxic air with a carbon dioxide concentration rising from the normal 0.04% to levels between 1.6% and 3.2%.
We reiterate that an administrative act such as the orders of 28 April 2023 and 27 December 2023 cannot impose any medical treatment, and that refusing to wear masks is lawful.
