An amendment to the law converting the so-called 'milleproroghe' decree (215/2023) should extend the suspension of fines for unvaccinated over-50s until 31/12/2024. The final vote is expected on 15 February.
If the amendment passes, as is almost certain, the fines, collection, payment, and any appeals would remain suspended until the end of the year. Therefore, the advice to do nothing for now remains valid. Naturally, we must await the approval and publication in the Official Gazette of the conversion law. Those who asserted the need to appeal the fines immediately because otherwise there would be a risk of enforcement action by the Revenue Agency were mistaken. Until the deadline for payment expires (sixty days after the end of the suspension period), collection is not possible and no deadline for lodging an appeal expires.
The excuse put forward by the government for failing to repeal the fines—namely the difficulty in finding financial cover, given that the expected revenue had supposedly already been included in the state budget—is not serious and demonstrates a lack of respect for the fundamental rights of citizens. It is worth recalling that under Art. 3 of the Charter of Nice, compulsory medical treatments are illegal and domestic rules providing for them must be disapplied.
