VICTORY AT THE CONSTITUTIONAL COURT

With judgment no. 50/2024, the Constitutional Court declared the unconstitutionality of provincial law no. 4/2020 of the Autonomous Province of Bolzano, which autonomously regulated emergency measures for the Autonomous Province, as this was a competence falling within the remit of the State. A small but significant victory secured by lawyer Fusillo, who assisted a restaurateur from Merano alongside lawyer Mark Antonio De Giuseppe. Indeed, the unconstitutionality of the Tyrolean provisions entails the unlawfulness of all the fines that were imposed on their basis. The question of the unlawfulness of the emergency rules remains open. We must continue to insist, by every means, that this travesty of the rule of law is eradicated from the Italian legal system.
