ALL COVID FINES MUST BE QUASHED

The Justice of the Peace of Livorno, in proceedings in which Avv. Fusillo defended Lenardo Facco, the founder of the Movimento Libertario, has quashed a penalty for failing to wear a face mask outdoors during a demonstration. The argument accepted is that of the more favourable treatment for those accused of an infringement (whether administrative or criminal). In other words, once the provision penalising a specific conduct (not wearing face masks, not showing the green pass, travelling from one municipality to another, etc.) has ceased to exist, it is no longer possible to impose a penalty for acts committed in the past. This argument potentially overturns all administrative penalties and may be used in all ongoing proceedings.
