Vaccination Mandate: how to defend yourself

The new vaccination mandate enters into force on 15 December 2021. From that date, professional regulatory bodies must send a new request for information regarding vaccination status to all healthcare workers who appear to be unvaccinated.

Until this request is received, do absolutely nothing.
Upon receipt of the official request, make an appointment for vaccination twenty days away, then send the letter requesting information that we had already prepared for the initial version of Decree-Law 44/2021 and which you can download from here. It must be sent to the location where you have been instructed to go for the vaccination (vaccination centre, pharmacy, etc.).

When attending the appointment, the basic strategy is that explained in the video at the bottom of the page.
It is very useful to go to the vaccination centre or pharmacy accompanied by a witness or, if possible, a lawyer. Here are the points to state:

    1. Ask the administering doctor to state in writing that the vaccine being offered to the healthcare worker prevents transmission of Sars-CoV-2. Pointing out to them that if they do so, they will be reported for making a false official statement, because according to the package leaflet this is not true. If they refuse to put anything in writing, call the Carabinieri or police to have the refusal and unfolding events formally recorded in the minutes, alongside the identification of all individuals present.
    2. Ask the administering doctor for the exact and exhaustive list of the chemical components of the vaccine, without exception, together with a statement, again in writing from the administering doctor, affirming under their own professional responsibility that they believe none of the components will adversely affect the patient's health.
    3. Ask the administering doctor to state in writing that, in their view, there are no issues whatsoever regarding potential complications and adverse effects such as: thrombosis, myocardial infarction, myocarditis, pericarditis, Bell's palsy, optic nerve damage, blindness.
    4. Ask the administering doctor or the director of the vaccination centre to declare in writing that the storage and transport temperatures of the vaccines have been scrupulously observed in accordance with the package leaflet.
    5. Point out to the vaccinator that, although a statutory shield against criminal liability exists, there is no exemption from civil liability for damage caused by the vaccine, and ask the administering doctor for the policy details and maximum coverage limit of their professional indemnity insurance.
    6. Have it entered into the record that the vaccine does not prevent transmission, as confirmed by the package leaflet (N.B. it is advisable to print the vaccine package leaflets from the internet and have them with you).
    7. State that you do not intend to refuse the vaccine, but to exercise your right to medical information provided for by Law 219/2017.
    8. Sign the consent form with the following wording: “I sign this form not of my own free will but under coercion by the threat of being suspended from my professional register and/or being barred from working; I consider myself the victim of extortion but have no alternative other than to sign the form, as otherwise I would be left without means of subsistence. In the event of adverse effects, I reserve the right to report the administering doctor, the local health authority (ASL), the government officials who imposed the vaccination mandate, and the pharmaceutical company that manufactured the vaccine. I ask the vaccinator to countersign this document. I further declare that this document contains no valid and comprehensive information to enable me to take an informed decision as provided for by Law 219/2017, as it clarifies nothing regarding the vaccine, short-, medium- and long-term adverse effects, or the procedures for pharmacovigilance reporting.”
    9. Submit my informed consent document (the one already sent by certified email [PEC] or registered post), requesting that it be completed in full. Have the Carabinieri record in the minutes that the vaccinator cannot or will not do so.
    10. Remind the vaccinator that, as a public official, they are bound to apply Article 3 of the Charter of Fundamental Rights of the European Union (Charter of Nice), which provides: “In the fields of medicine and biology, the following must be respected in particular: the free and informed consent of the person concerned, according to the procedures laid down by law”, and ask them for detailed information regarding the compatibility of the vaccination mandate introduced by Decree-Law 44/2021 with the provisions of the Charter of Nice.

The objective is to leave the vaccination centre with official minutes showing that the doctor, being unable to answer the requests, must hold the vaccination in abeyance. This strategy, being based on genuine and scientifically proven issues, has yielded excellent results, but requires firmness and determination on your part during the exchange with the doctor. You may encounter administering doctors with hostile and aggressive attitudes; for this reason, the presence of a witness or, if possible, a lawyer is helpful.
